Three Businesses Fined For Illegally Dumping Rubbish

Restaurants in Hanwell and Southall taken to court

Three businesses have received hefty fines for fly-tipping offences following action by Ealing Council.

The cases, which all relate to the incorrect disposal of business waste, were heard at Ealing Magistrates Court on Thursday, 14 April 2011.

Mr Lavithakis Ioannides, the owner of Rendezvous café, 109 Uxbridge Road, Hanwell, pleaded guilty to six separate cases of depositing and failing in his duty of care to stop his staff dumping waste on the pavement outside his café. All of these offences happened in January 2011. He was fined £65 for each offence and ordered to pay full costs of £626.13. With an added victim surcharge of £15, the total amount he has to pay is £1031.31.

Mr Athnasious, director of company Nineveh Ltd which operates Amera Restaurant at 99 Uxbridge Road, Hanwell, pleaded guilty to five waste offences that took place in December 2010 and January 2011. The magistrates found the company had failed in its duty of care to stop staff depositing waste outside the restaurant. The company was fined £65 for each offence, ordered to pay £753.05 to cover the full costs and a £15 victim surcharge making a total of £1093.05.

In a third case, Silversub Restaurant Ltd was found guilty of five offences of failing in its duty of care to stop staff dumping rubbish outside Rockers Fast Food, 63 The Green, Southall, in November and December 2010. The company was not represented in court and was fined £400 for each offence plus full costs of £761.04 and a £15 victim surcharge, totalling £2,776.04.

Councillor Bassam Mahfouz, cabinet member for Transport and Environment, said:
“I hope these prosecutions will send out a message to anyone who thinks they can get away with fly-tipping. The council works hard to make sure our borough’s streets are kept clean and this sort of irresponsible behaviour will not be tolerated in Ealing.

“Everyone has a responsibility to keep the borough clean and tidy and our officers make sure that businesses are fully aware of their duty. It is easy and at a small cost to the business to either sign-up to our waste collection service, or employ a private contractor. I would urge anyone who witnesses fly-tipping to report it to Grimebusters, our 24-hour hotline."
